Liability in Defective Products Claims
Regardless of the intent of the manufacturer, it can be held responsible for any of its products that it distributed and placed consumers at risk by using them. If the distributed product is deemed unsafe, the manufacturer is liable because they did not test their product thoroughly enough to determine potential safety hazards. A warning label is normally on any product that is potentially unsafe or hazardous.
The following are the three most common cases for a product liability claim:
- Design defect – if a product is shown to break or damage more easily than it should, this would constitute a design defect. If a consumer is using a product that breaks unexpectedly, it puts the consumer at risk of injury.
- Manufacturing defect – a product that is distributed without an error being fixed is considered a manufacturing defect. Products that are distributed need to be thoroughly tested for durability to ensure that they can be used without subjecting consumers to safety hazards.
- Inadequate warning / no warning label – any potentially harmful or hazardous product needs to warn consumers of the dangers of the product. If the product does not have a warning label, there is no way for any consumer to know the potential risks of using that product.
