Negligent security may be asserted by individuals who are attacked or victimized on another person’s property. While there are many conditions that can make a property unsafe, negligent security addresses only unsafe conditions that pertain to third party attacks.

To recover damages in a negligent security action, the victim must show:

  1. The property owner on which the attack occurred owed a duty of care to the victim;
  2. The property owner breached that duty of care; and
  3. The owner’s breach was the proximate cause of the injuries suffered by the victim

Arizona is one of 10 states that allow the court to compare the fault of all parties involved; so when a victim wants to hold a negligent individual responsible for failing to control another individual who acted intentionally, the negligent party can shift fault to the individual who acted intentionally. For example, if Jane Doe is raped in an apartment parking garage, the jury may consider the amount of fault of the landlord (negligent individual) and the rapist (the individual acting intentionally). Other states would not allow the landlord or management company to shift any portion of the fault to the rapist. Hutcherson v. City of Phoenix, 961 P.2d 449 (Ariz. 1998).
