If a person negligently operates a vehicle that results in damage to another person or their property, then the negligent driver may owe the injured party damages. Operating a vehicle requires drivers to meet a “reasonable person” standard. Defining “reasonable person” requires asking a question—if another motorist were in the same situation (which includes obeying traffic laws and being aware of pedestrians and other drivers), would that motorist react the same way you did? Failure to meet this standard may be considered during a damages determination.
Auto accidents occur for an endless number of reasons, many of which may not relate to a driver’s conduct. Manufacturers and mechanics may be responsible for damages that arise from a car accident. A product liability lawsuit can be brought against the manufacturer of the faulty part that played a role in the car accident. The city may also be responsible for damages that result from a car accident due to traffic signals or improper maintenance of highways or roadways. Any establishment that serves alcohol may be responsible for damages if they serve alcohol to a patron who is clearly intoxicated and drives and injures a third party.
