Thirty-five year-old Colene Barker of Mesa was arrested on Monday night, December 26th. According to the report, Barker intentionally struck her husband with her car and then drove over his legs. She then exited her vehicle and mocked him.
Barker told police that she did this to teach him a lesson for committing adultery. Barker’s husband had filed for divorce and was living with his girlfriend at the time. The incident took place in the parking lot of the apartment complex where he was living.
Barker’s husband admitted that he committed adultery. This may have given either of the spouses a reason to file for divorce, but not grounds for assault.
Barker husband was treated for “numerous lacerations” at Desert Banner Medical Center. He refused to press criminal charged stating that “it’s my entire fault.” Barker was arrested for aggravated assault and criminal damage.
Barker’s husband may change his mind and pursue a civil lawsuit for any medical bills he has as a result of his injuries, lost wages, and pain and suffering. Barker had an obligation not to assault him with her car; and by hitting him, she could be financially liable for the resulting damages. Barker’s husband has up to two years from learning of his injuries to file a civil lawsuit.
