On Saturday, November 26th, a solo vehicle accident claimed the life of a Scottsdale teen. The accident occurred near 10:30pm on southbound Interstate 17 near Flagstaff. The Arizona Department of Public Safety has not determined what caused the 2003 Isuzu to roll several times. Seventeen year-old William Mandel Waldo IV was not wearing his seatbelt, was ejected from the vehicle, and died from his injuries.
The driver, 17 year-old Parker Shanks of Chandler, was wearing his seatbelt and seriously injured in the accident. He was taken to Flagstaff Medical Center for treatment.
If Shanks is found to be responsible for the accident, he could face a civil lawsuit for wrongful death from Waldo’s parents for causing their son’s death. A wrongful death claim may be brought by the survivors of someone who has died due to another person’s negligence. If Waldo’s parents sue for wrongful death, they will request the damages that their son would have been able to collect from Shanks for negligence if he had survived the accident. Arizona Revised Statutes §§ 12-611 – 12-613 govern wrongful death lawsuits.
