According to Glendale Police Department Detective Jeff Daukas, twenty-three-year-old (23) Misty Baisden was killed over the weekend when she hit a parked car causing her vehicle to roll. The accident occurred on Saturday around ten (10) a.m. at the intersection of Myrtle Avenue and 55th Drive in Glendale. Detective Daukas said Ms. Baisden was traveling east on Myrtle when she hit the other vehicle. The cause of the accident is still under investigation.
According to Arizona Revised Statute § 12-611, “When death of a person is caused by wrongful act, neglect or default, and the act, neglect or default is such as would, if death had not ensued, have entitled the party injured to maintain an action to recover damages in respect thereof, then, and in every such case, the person who . . . would have been liable if death had not ensued shall be liable to an action for damages . . . .” Under Arizona Revised Statute § 12-613, wrongful death damages will be awarded based on what is “fair and just with reference to the injury resulting from the death.” Finally, Arizona law allows the decedent’s husband, wife, parent, guardian, child or personal representative to recover damages for the decedent’s wrongful death.
