When a person dies at the fault of another, certain family members are entitled to recover compensation through the filing of a wrongful death lawsuit. A wrongful death lawsuit is different from a personal injury lawsuit in that a wrongful death claim is filed by a family member of the deceased or the deceased’s estate, whereas, a personal injury claim is filed by the victim of the accident. Further, the purpose of a wrongful death claim is to provide monetary compensation for the emotional and financial injuries suffered by the family members of the deceased. Alternatively, the purpose of a personal injury lawsuit is to provide the victim with compensation based on the injuries he/she suffered as a result of the accident.
