The family of Clarence Mobley, a Riker’s Island inmate arrested on attempted burglary charges, recently settled a wrongful death lawsuit against New York City for $525,000. According to the lawsuit, Mr. Mobley was “subdued” by three officers, and guards failed to provide him with immediate medical attention for his injuries. Although the medical examiner determined that Mr. Mobley’s death was a homicide, criminal charges have not been filed against the corrections officers that were named in the Lawsuit.
A wrongful death lawsuit is a suit brought by the survivors of a person who died as a result of the negligence of another. Specifically, a wrongful death suit may be brought by a surviving spouse, a parent whose child has passed, or the personal representative of the decedent’s estate. In addition, there may be multiple beneficiaries of the lawsuit, and recovery from the suit will be allocated among each of the beneficiaries based on the loss suffered by each. Further, there are several different types of damages that a jury may award in a wrongful death suit: (1) Loss of consortium which includes loss of love, affection, care, companionship, and guidance; (2) Pain and suffering which includes pain, grief, stress, shock, and anguish; (3) Loss of income; (4) Medical expenses; (5) Punitive damages.
