Eighteen-Year-Old Faces First Degree Murder Charges. Find a Criminal Lawyer for your Criminal Case

According to Phoenix Police Sergeant Steve Martos, eighteen-year-old Kevin Anderson has been booked on one count of first-degree murder and three counts of aggravated assault for killing a family friend, critically wounding his stepfather, and injuring another family friend.  Authorities said that Mr. Anderson shot his stepfather during an argument at an apartment complex near 12th Street and Bell Road.  Mr. Anderson’s Mother and two family friends were in the apartment when the shooting began and ran outside to escape.  Nevertheless, Mr. Anderson followed them outside, and shot at his Mother.  However, a family friend pushed her out of the way, was hit by the bullet and suffered a non-threatening gunshot wound.  Police said that Mr. Anderson then shot another family friend, Linda Whiting.  Ms. Whiting was taken to the hospital where she was later pronounced dead. After the shooting, Mr. Anderson fled the scene, but he returned to the apartment three hours later and was arrested by police.

Arizona Revised Statute § 13-1105 states “A person commits first degree murder if: intending or knowing that the person’s conduct will cause death, the person causes the death of another person . . . .”  Under this statute, first degree murder is a Class 1 felony charge and may result in penalties such as twenty-five years to life in prison without the possibility of parole, life in prison without the possibility of parole or the death penalty.  However, a person charged with first degree murder may have a valid defense for his actions.  For example, one common defense to first degree murder is self defense: the use of deadly force to protect oneself against a person threatening to use or using deadly force against them.
