The family of Sergio Adrian Hernandez Guereca, a fifteen-year-old Mexican boy, has filed a $25 million wrongful death suit against the United States government. The lawsuit is based on an incident that occurred on June 7, 2010 in which a border patrol agent shot and killed Sergio while trying to arrest illegal immigrants attempting to cross the border into Texas. According to FBI spokeswoman, Andrea Simmons, at the time of the incident, a group of people were throwing rocks at the agents, and agents are generally permitted to use lethal force in response to rock throwing. Further, federal arrest records show that Sergio was arrested at least four times in 2008 and twice in 2009 on suspicion of smuggling illegal immigrants across the border into the United States. However, Sergio was never actually charged for any of these offenses.
According to Sergio’s family’s attorney, Bob Hillard, witnesses of the incident denied that anyone was throwing rocks. Instead, the Complaint alleges that Sergio and his friends were merely running up to the border fence, touching the fence, and then running away. A border patrol agent had detained one of the boys, according to the Complaint, and Sergio was watching from across the border when he was shot by the agent. The Complaint further alleges that after the agent shot Sergio, “More U.S. border patrol agents arrived on scene, the shooter picked up his bicycle, and then they all left. No one took any action to render emergency medical aid to Sergio, leaving him dead or dying beneath Paseo del Norte Bridge in the territory of Mexico. Shortly thereafter, Mexican police arrived on scene and pronounced Sergio dead.” Mr. Hillard further said that Sergio “had no weapon and was no imminent threat to the officer.”
